Terms and Conditions

The following Terms and Conditions relate to The Great Jersey Photo Challenge (the “Challenge”):

Visit Jersey Limited (the “Promoter), is a company registered in Jersey with registration number 116716 whose registered office is 3rd Floor Commercial House, 3 Commercial Street, St Helier, Jersey, JE2 3RU.

1.0 The Challenge is not open to employees of the Promoter, their families, agents or anyone professionally connected with the promotion.

2.0 The Challenge is open to UK and Channel Island residents. Entrants under the age of 18 must have consent of a parent or guardian to enter the challenge. Visit Jersey reserves the right to obtain proof of such consent and to refuse entry or to choose another winner if such proof, where requested, has not been given.

3.0 Between 02 April – 01 May 2022, participants will have the option to enter the Challenge by submitting their own user-generated content in the form of photographs of Jersey (the “Content”) online through the CrowdRiff Collector platform.

3.1 To enter the Challenge, participants must submit content through one of the following 2 actions.

a) Participants can use the hashtag #JerseyPhotoChallenge within the Instagram platform.

b) Participants can visit the webpage www.jersey.com/photo-challenge and use the image collector tool.

3.2 By entering the Challenge and submitting their Content, the Participant confirms that the Promoter has the rights to publish the Content on the Promoter’s website (www.Jersey.com) and social media channels.

3.3 There is no limit on the number of entries a participant can submit.

4.0 On or around 01 May 2022 the Promoter will select an overall ‘winner’. Their image will be shared on the Promotor’s social channels and website.

4.1 The winner will be notified within 14 days of the Challenge closing and they have 14 days to claim their prize. They will win a Jersey themed goodie bag.

4.2 The prize is as stated and no cash or other alternatives will be offered.

5.0 By submitting Content to the Challenge, you represent and warrant that:

a) You own all rights in and to your Content including without limitation, all rights to the audio, video and/or digital recording and performance contained in your Content (if any) and/or you have acquired all necessary rights to the elements appearing in your Content to enable you to grant the same rights to the Promoter as described herein;

b) Your Content is wholly original and does not infringe on the copyright, trademark, patent, trade secret, or any other intellectual property rights, privacy rights, or any other legal or moral rights of any third-party individual or entity.

c) If you submit any content that includes material the rights in which are owned by a third party, including intellectual property rights such as copyright and trademarks, you will be responsible for any legal action that party may take against you.

d) Any information contained in your Content is not known to you to be false, inaccurate, or misleading.

e) Your Content does not violate any law.

f) You were not and will not be compensated or granted any consideration by any third party for submitting your Content;

g) You will not be compensated or granted any consideration in any way by the Promoter for the use of your Content.

h) Your Content does not incorporate materials from a third-party website, copyright protected materials, or personally identifiable information of anyone other than yourself or those that have given their permission; and

i) Your Content does not reflect negatively in any way upon the Promoter or their marketing, advertising, commercial, or promotional efforts.

6.0 No entries from agents, third parties, organised groups or entries automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted. Entries will only be accepted if they comply with all entry instructions.

7.0 Entry into the Challenge will be deemed as acceptance of these terms and conditions.

8.0 Responsibility is not accepted for entries lost or delayed for any reason whatsoever.

9.0 In the event of any dispute, the decision of the Promoter is final. No communications or correspondence will be entered into regarding the Promoter’s decision.

10.0 The winner’s details (name and country) will be made available on request, with expressed permission of the winner, to those writing to Visit Jersey, Commercial House, 3 Commercial Street, 3rd Floor, St. Helier, Jersey, JE2 3RU within six weeks after the published closing date, enclosing a stamped SAE.

11.0 Entrants may be invited to participate in publicity arising from this promotion, although they are under no obligation to do so and will only participate with their expressed consent.
This promotion is in no way sponsored, endorsed or administered by any other organisation other than Visit Jersey Limited.

12.0 By entering the Challenge, all entrants will be deemed to have accepted and be bound by the rules and consent to the transfer of their personal data to the Promoter for the purposes of the administration of this promotion and any other purposes to which the entrant has consented.  All entry instructions form part of the rules.

13.0 By entering the Challenge and submitting their Content, the participant confirms that the Promoter has the rights to publish the Content on the Promoter’s website (www.Jersey.com) and social media channels.

These Terms and Conditions shall be governed by Jersey Law.
